The Trade Union Law of the People's Republic of China
1992年4月3日第七屆全國人民代表大會(huì)第五次會(huì)議通過(Adopted 3 April 1992 at the 5th Session of the 7th
National People's Congress.)
第一條 為保障工會(huì)在國家政治、經(jīng)濟(jì)和社會(huì)生活中的地位,確定工會(huì)的權(quán)利與義務(wù),發(fā)揮工會(huì)在社會(huì)主義現(xiàn)代化建設(shè)事業(yè)中的作用,根據(jù)憲法,制定本法。
Article 1 This Law is formulated in accordance with the Constitution in order to
protect the position of trade unions in State political, economic and social
life, to clarify the rights and obligations of trade unions and to enable them
to play their proper role in the development of China's socialist modernization.
第二條 工會(huì)是職工自愿結(jié)合的工人階級的群眾組織。
Article 2 Trade unions are mass organizations formed by the working classes of
their own free will.
第三條
在中國境內(nèi)的企業(yè)、事業(yè)單位、機(jī)關(guān)中以工資收入為主要生活來源的體力勞動(dòng)者和腦力勞動(dòng)者,不分民族、種族、性別、職業(yè)、宗教信仰、教育程度,都有依法參加和組織工會(huì)的權(quán)利。
Article 3 All workers doing physical or mental work in enterprises, public
institutions and government organs within Chinese territory who earn their
living primarily from wages shall have the right to participate in and form
trade union organizations pursuant to the law, regardless of their nationality,
race, sex, occupation, religious beliefs or level of education.
第四條 工會(huì)必須遵守和維護(hù)憲法,以憲法為根本的活動(dòng)準(zhǔn)則,依照工會(huì)章程獨(dú)立自主地開展工作。
Article 4 Trade unions must abide by and safeguard the Constitution and use the
Constitution as the standard for their basic activities. Trade union work shall
be carried out independently and voluntarily in accordance with the Constitution
of Trade Unions.
工會(huì)會(huì)員全國代表大會(huì)制定或者修改《中國工會(huì)章程》,章程不得與憲法和法律相抵觸。
The trade union members national representative assembly shall formulate or
amend the Constitution of the All-China Federation of Trade Unions, which shall
be prohibited from conflicting in any way with China's Constitution and laws.
國家保護(hù)工會(huì)的合法權(quán)益不受侵犯。
The State shall protect the legal rights and interests of trade unions and any
infringement of these rights and interests shall be prohibited.
第五條
工會(huì)組織和教育職工依照憲法和法律的規(guī)定行使民主權(quán)利,發(fā)揮國家主人翁的作用,通過各種途徑和形式,參與管理國家事務(wù),管理經(jīng)濟(jì)和文化事業(yè),管理社會(huì)事務(wù);協(xié)助人民政府開展工作,維護(hù)工人階級領(lǐng)導(dǎo)的、以工農(nóng)聯(lián)盟為基礎(chǔ)的人民民主專政的社會(huì)主義國家政權(quán)。
Article 5 Trade unions shall organize and educate workers to exercise their
democratic rights pursuant to the provisions of China's Constitution and laws,
give full play to the nation's role as master, participate through various
channels and formats in the management of national affairs, economic and
cultural institutions and social matters, assist the people's governments to
develop work opportunities, uphold the leadership or the working classes and
support the worker-peasant alliance which forms the basis of the people's
democratic dictatorship of socialist state power.
第六條 工會(huì)在維護(hù)全國人民總體利益的同時(shí),維護(hù)職工的合法權(quán)益。
Article 6 While upholding the overall rights and interests of the whole nation,
trade unions shall, at the same time, safeguard the rights and interests of
workers.
工會(huì)必須密切聯(lián)系職工,聽取和反映職工的意見和要求,關(guān)心職工的生活,幫助職工解決困難,全心全意為職工服務(wù)。
A trade union must liaise closely with workers, listen to and reflect their
views and requirements, care for their livelihood, assist them in overcoming
difficulties and serve them wholeheartedly.
第七條 全民所有制和集體所有制企業(yè)事業(yè)單位的工會(huì),組織職工依照法律規(guī)定參加本單位的民主管理和民主監(jiān)督。
Article 7 The trade union of an enterprise or public institution owned by the
whole people or a collectively owned enterprise or public institution shall
organize its workers to participate in the said unit's democratic management and
democratic supervision pursuant to the provisions of the law.
第八條 工會(huì)動(dòng)員和教育職工以主人翁態(tài)度對待勞動(dòng),愛護(hù)國家和企業(yè)的財(cái)產(chǎn),遵守勞動(dòng)紀(jì)律,發(fā)動(dòng)和組織職工努力完成生產(chǎn)任務(wù)和工作任務(wù)。
Article 8 A trade union shall mobilize and educate workers to approach work with
the attitude of being the master, to care for State and enterprise property and
observe labour discipline and shall urge and organize workers to conscientiously
complete production and work assignments.
工會(huì)組織職工開展社會(huì)主義勞動(dòng)競賽,開展群眾性的合理化建議、技術(shù)革新和技術(shù)協(xié)作的活動(dòng),提高勞動(dòng)生產(chǎn)率和經(jīng)濟(jì)效益,發(fā)展社會(huì)生產(chǎn)力。
A trade union shall organize workers to launch socialist labour emulation
campaigns, develop mass rationalization proposals, technological reform and
technological cooperation activities, improve work productivity rates and
economic performances and develop society's productive forces.
第九條
工會(huì)對職工進(jìn)行愛國主義、集體主義、社會(huì)主義教育,民主、法制、紀(jì)律教育,以及科學(xué)、文化、技術(shù)教育,提高職工的思想、道德和科學(xué)、文化、技術(shù)、業(yè)務(wù)素質(zhì),使職工成為有理想、有道德、有文化、有紀(jì)律的勞動(dòng)者。
Article 9 A trade union shall educate workers in matters of patriotism,
collectivism and socialism, democracy, legality and discipline and science,
culture and technology, raise the ideological thoughts, ethics and scientific,
cultural, technological and professional qualities of workers and enable them to
become labourers with ideals, ethics, education and discipline.
第十條 中華全國總工會(huì)根據(jù)獨(dú)立、平等、互相尊重、互不干涉內(nèi)部事務(wù)的原則,加強(qiáng)同各國工會(huì)組織的友好合作關(guān)系。
Article 10 The All-China Federation of Trade Unions shall, in accordance with
the principles of independence, equality, mutual respect and mutual
non-interference in internal affairs, improve the relations of friendly
cooperation held with the trade union organizations of various other nations.
第二章 工會(huì)組織CHAPTER II TRADE UNION ORGANIZATIONS
第十一條 工會(huì)各級組織按照民主集中制原則建立。
Article 11 Trade union organizations at the various levels shall be established
in accordance with the principle of democratic centralism.
各級工會(huì)委員會(huì)由會(huì)員大會(huì)或者會(huì)員代表大會(huì)民主選舉產(chǎn)生。
Trade union committees at the various levels shall be elected by their general
assemblies or representative assemblies.
各級工會(huì)委員會(huì)向同級會(huì)員大會(huì)或者會(huì)員代表大會(huì)負(fù)責(zé)并報(bào)告工作,接受其監(jiān)督。
Trade union committees at the various levels shall be responsible to and shall
submit work reports to general assemblies or representative assemblies at their
respective levels and shall be subject to their supervision.
工會(huì)會(huì)員大會(huì)或者會(huì)員代表大會(huì)有權(quán)撤換或者罷免其所選舉的代表或者工會(huì)委員會(huì)組成人員。
Trade union general assemblies and representative assemblies shall have the
right to change or dismiss their elected representatives or committee members.
上級工會(huì)組織領(lǐng)導(dǎo)下級工會(huì)組織。
Higher level trade union organizations shall provide leadership to lower level
trade union organizations.
第十二條 企業(yè)、事業(yè)單位、機(jī)關(guān)有會(huì)員二十五人以上的,可以建立基層工會(huì)委員會(huì);會(huì)員不足二十五人的,選舉組織員一人,組織會(huì)員開展活動(dòng)。
Article 12 The trade union of an enterprise, public institution or government
organ with 25 or more members may establish a primary trade union committee. If
members number less than 25, one organizer may be elected to organize activities
for members.
縣級以上地方建立地方各級總工會(huì)。
A locality at county level or above shall establish a local all-level federation
of trade unions.
同一行業(yè)或者性質(zhì)相近的幾個(gè)行業(yè),可以根據(jù)需要建立全國的或者地方的產(chǎn)業(yè)工會(huì)。
Several enterprises operating in the same industry or in industries of a similar
nature may establish a national or local specific industry trade union,
depending on their requirements.
全國建立統(tǒng)一的中華全國總工會(huì)。
The All-China Federation of Trade Unions shall operate uniformly at a national
level.
第十三條 基層工會(huì)、地方各級總工會(huì)、全國或者地方產(chǎn)業(yè)工會(huì)組織的建立,必須報(bào)上一級工會(huì)批準(zhǔn)。
Article 13 The establishment of a primary trade union, local all-level
federation of trade unions or a national or local specific industry trade union
must be reported to the trade union organization at the next highest level for
approval.
基層工會(huì)組織所在的企業(yè)終止或者所在的事業(yè)單位、機(jī)關(guān)被撤銷,該工會(huì)組織相應(yīng)撤銷。
If a primary trade union organization's enterprise terminates its operations or
its public institution or administrative organ is abolished, the said trade
union organization shall also be abolished.
第十四條 中華全國總工會(huì)、地方總工會(huì)、產(chǎn)業(yè)工會(huì)具有社會(huì)團(tuán)體法人資格。
Article 14 The All-China Federation of Trade Unions, local all-level federations
of trade unions and specific industry trade unions shall have the legal person
status of a social group.
基層工會(huì)組織具備民法通則規(guī)定的法人條件的,依法取得社會(huì)團(tuán)體法人資格。
Primary trade union organizations complying with the legal person requirements
stipulated by the general Principles of Civil Law shall be awarded the legal
person status of a social group pursuant to the law.
第十五條 工會(huì)主席、副主席任期未滿時(shí),不得隨意調(diào)動(dòng)其工作。因工作需要調(diào)動(dòng)時(shí),應(yīng)當(dāng)征得本級工會(huì)委員會(huì)和上一級工會(huì)的同意。
Article 15 During their terms of office, a trade union chairman and deputy
chairman shall be prohibited from arbitrarily transferring to other positions.
If work requirements necessitate such a move, approval shall be obtained from
the respective level trade union committee and higher level trade union.
第三章 工會(huì)的權(quán)利和義務(wù)CHAPTER III RIGHTS AND OBLIGATIONS OF A TRADE UNION
第十六條 全民所有制和集體所有制企業(yè)事業(yè)單位違反職工代表大會(huì)制度和其他民主管理制度,工會(huì)有權(quán)提出意見,保障職工依法行使民主管理的權(quán)利。
Article 16 If an enterprise or public institution owned by the whole people or a
collectively owned enterprise or public institution violates the provisions of
the worker representative assembly system or other democratic management
systems, the trade union of the said unit shall have the right to put forward
its views and ensure that the workers' rights to democratic management are
implemented pursuant to the law.
工會(huì)可以派出代表對所屬工會(huì)組織所在的企業(yè)、事業(yè)單位、機(jī)關(guān)就侵犯職工合法權(quán)益的問題進(jìn)行調(diào)查,有關(guān)單位應(yīng)當(dāng)予以協(xié)助。
A trade union may appoint a representative to investigate problems in relation
to infringements of the legal rights and interests of workers of the said
enterprise or public institution within which it has been established and the
said unit shall be obliged to provide the necessary assistance.
第十七條 企業(yè)、事業(yè)單位違反勞動(dòng)法律、法規(guī),侵犯職工合法權(quán)益,工會(huì)有權(quán)要求企業(yè)、事業(yè)單位行政方面或者有關(guān)部門認(rèn)真處理。
Article 17 If an enterprise or public institution violates labour laws or
statutory regulations, thereby infringing on the legal rights and interests of
workers, the trade union shall have the right to request that the said
enterprise or public institution's administrative authority or other relevant
departments deal with the matter seriously.
企業(yè)、事業(yè)單位違反國家有關(guān)勞動(dòng)(工作)時(shí)間的規(guī)定,工會(huì)有權(quán)要求企業(yè)、事業(yè)單位行政方面予以糾正。
If an enterprise or public institution violates State provisions on labour
(work) hours, the trade union shall have the right to request that the said
enterprise or public institution's administrative authority rectifies the
matter.
企業(yè)、事業(yè)單位違反保護(hù)女職工特殊權(quán)益的法律、法規(guī),工會(huì)及其女職工組織有權(quán)要求企業(yè)、事業(yè)單位行政方面予以糾正。
If an enterprise or public institution violates a law or statutory regulation
safeguarding the special rights and interests of women employees, the trade
union and its female employee organization shall have the right to request that
the said enterprise or public institution's administrative authority rectifies
the matter.
第十八條 工會(huì)幫助、指導(dǎo)職工與企業(yè)、事業(yè)單位行政方面簽訂勞動(dòng)合同。
Article 18 A trade union shall assist and provide guidance to workers signing
labour contracts with the enterprise or public institution's administrative
authority.
工會(huì)可以代表職工與企業(yè)、事業(yè)單位行政方面簽訂集體合同。集體合同草案應(yīng)當(dāng)提交職工代表大會(huì)或者全體職工討論通過。
A trade union may represent workers in signing a collective contract with an
enterprise or public institution's administrative authority. The draft of a
collective contract shall be submitted to a meeting of employee representatives
or the complete body of employees for discussion and adoption.
第十九條 企業(yè)辭退、處分職工,工會(huì)認(rèn)為不適當(dāng)?shù)模袡?quán)提出意見。
Article 19 A trade union which believes that an enterprise's dismissal or
penalizing of an employee is inappropriate shall have the right to put forward
its views on the matter.
全民所有制和集體所有制企業(yè)在做出開除、除名職工的決定時(shí),應(yīng)當(dāng)事先將理由通知工會(huì),如果企業(yè)行政方面違反法律、法規(guī)和有關(guān)合同,工會(huì)有權(quán)要求重新研究處理。
When making a decision to dismiss or remove an employee's name from its books,
an enterprise owned by the whole people or a collectively owned enterprise shall
first notify the trade union of its reasons for such a decision. If the
enterprise's administrative authority is found to have violated the provisions
of the law, statutory regulations or the relevant contract, the trade union
shall have the right to request that the cases be reinvestigated and dealt with
anew.
當(dāng)事人對企業(yè)行政方面作出的辭退、開除、除名的處理不服的,可以要求依照國家有關(guān)處理勞動(dòng)爭議的規(guī)定辦理。
A party disagreeing with the penalty decision of an enterprise's administrative
authority to dismiss or remove the said party's name from its books may request
that the case be dealt with in accordance with relevant State provisions on the
handling of labour disputes.
第二十條 工會(huì)參加企業(yè)的勞動(dòng)爭議調(diào)解工作。
Article 20 A trade union shall participate in mediation work conducted in
relation to labour disputes within its enterprise.
地方勞動(dòng)爭議仲裁組織應(yīng)當(dāng)有同級工會(huì)代表參加。
Equivalent level trade union representatives shall participate in district
labour dispute arbitration organizations.
第二十一條 企業(yè)侵犯職工勞動(dòng)權(quán)益的,工會(huì)可以提出意見調(diào)解處理;職工向人民法院起訴的,工會(huì)應(yīng)當(dāng)給予支持和幫助。
Article 21 If an enterprise infringes on the work rights or interests of an
employee, the trade union may put forward its views on mediation and handling of
the matter. If an employee initiates legal proceedings with a people's court,
the trade union shall give its support and assistance.
第二十二條 縣級以上各級總工會(huì)可以為所屬工會(huì)和職工提供法律咨詢服務(wù)。
Article 22 Trade union federations at county level or above may provide legal
consultancy services to affiliated trade unions and workers.
第二十三條 工會(huì)依照國家規(guī)定對新建、擴(kuò)建企業(yè)和技術(shù)改造工程中的勞動(dòng)條件和安全衛(wèi)生設(shè)施有權(quán)提出意見,企業(yè)或者主管部門應(yīng)當(dāng)認(rèn)真處理。
Article 23 A trade union shall, pursuant to State regulations, have the right to
put forward views on work conditions and safety and hygiene facilities for a
newly constructed or expanded enterprise or one undergoing technological
transformation, and the said enterprise or its department in charge shall
conscientiously endeavour to meet such requirements.
第二十四條
工會(huì)發(fā)現(xiàn)企業(yè)行政方面違章指揮、強(qiáng)令工人冒險(xiǎn)作業(yè),或者生產(chǎn)過程中發(fā)現(xiàn)明顯重大事故隱患和職業(yè)危害,有權(quán)提出解決的建議;當(dāng)發(fā)現(xiàn)危及職工生命安全的情況時(shí),有權(quán)向企業(yè)行政方面建議組織職工撤離危險(xiǎn)現(xiàn)場,企業(yè)行政方面必須及時(shí)作出處理決定。
Article 24 If a trade union discovers that an enterprise's administrative
authority is breaking rules and regulations by directing or forcing workers to
undertake risks or if distinct and significant hidden dangers or occupational
hazards are discovered during the production process, the trade union shall have
the right to suggest a resolution. On discovering a situation where the personal
safety of workers is jeopardized, a trade union shall have the right to suggest
to the enterprise's administrative authority that the workers abandon the
dangerous site and the said administrative authority must decide promptly on
measures to resolve the matter.
工會(huì)有權(quán)參加傷亡事故和其他嚴(yán)重危害職工健康問題的調(diào)查,向有關(guān)部門提出處理意見,并有權(quán)要求追究直接負(fù)責(zé)的行政領(lǐng)導(dǎo)人和有關(guān)責(zé)任人員的責(zé)任。
A trade union shall have the right to participate in investigations into an
accident resulting in a fatality or injury or other problems seriously
endangering the health of workers. It may suggest resolutions to the relevant
authorities, as well as have the right to require the pursuit of the liability
of the administrative leaders directly responsible and other responsible
parties.
第二十五條 企業(yè)發(fā)生停工、怠工事件,工會(huì)應(yīng)當(dāng)會(huì)同企業(yè)行政方面或者有關(guān)方面,協(xié)商解決職工提出的可以解決的合理的要求,盡快恢復(fù)正常生產(chǎn)秩序。
Article 25 If an enterprise is subject to stop work or slow down measures, the
trade union shall, in conjunction with the enterprise's administrative authority
or other relevant authorities, negotiate a resolution of demands raised by the
workers which are found to be reasonable and able to be resolved so as to enable
the normal production process to be resumed as quickly as possible.
第二十六條 工會(huì)協(xié)助企業(yè)、事業(yè)單位、機(jī)關(guān)行政方面辦好職工集體福利事業(yè),做好工資、勞動(dòng)保護(hù)和勞動(dòng)保險(xiǎn)工作。
Article 26 Trade unions shall assist the administrative authorities of
enterprises, public institutions and government organs to organize employee
collective welfare matters and wage, labour protection and labour insurance
work.
第二十七條 工會(huì)會(huì)同行政方面組織職工開展業(yè)余文化、技術(shù)學(xué)習(xí)和職工培訓(xùn),提高職工的文化、業(yè)務(wù)素質(zhì);組織職工開展文娛、體育活動(dòng)。
Article 27 Trade unions shall, in conjunction with administrative authorities,
organize employees to undertake after-hours cultural and technical studies and
occupational training so as to improve the cultural and occupational quality of
the workers, as well as organize them to develop recreational and sports
activities.
第二十八條
縣級以上各級人民政府制定國民經(jīng)濟(jì)和社會(huì)發(fā)展計(jì)劃,省、自治區(qū)的人民政府所在地的市和經(jīng)國務(wù)院批準(zhǔn)的較大的市以上的人民政府研究起草法律或者法規(guī)、規(guī)章,對涉及職工利益的重大問題,應(yīng)當(dāng)聽取同級工會(huì)的意見。
Article 28 The views of trade unions shall be listened to when national economic
and social development plans formulated by the various levels of people's
governments at county level or above and draft laws and statutory rules and
regulations researched by municipalities under provincial and autonomous region
people's governments and people's governments of relatively large municipalities
approved by the State Council involve important issues relating to the rights
and interests of workers.
縣級以上各級人民政府及其有關(guān)部門在研究制定工資、物價(jià)、安全生產(chǎn)以及勞動(dòng)保護(hù)、勞動(dòng)保險(xiǎn)等重大政策、措施時(shí),應(yīng)當(dāng)吸收同級工會(huì)參加研究,聽取工會(huì)意見。
When the various levels of people's governments at county level or above and
their relevant authorities formulate important policies or measures on wages,
commodity pricing, production safety, labour protection, labour insurance, etc,
equivalent level trade unions shall be recruited to participate in the research
work and the views of the said trade unions shall be heeded.
第二十九條 縣級以上地方各級人民政府可以采取適當(dāng)方式,向同級工會(huì)通報(bào)政府的重要的工作部署和與工會(huì)工作有關(guān)的行政措施,研究解決工會(huì)反映的職工群眾的意見和要求。
Article 29 The various levels of people's governments at county level or above
may adopt appropriate methods to report the respective government's important
work plans and administrative measures relating to trade union work to their
equivalent level trade unions and shall study and determine ways of handling the
suggestions and requests of the working masses as reflected through the trade
unions.
第四章 基層工會(huì)組織CHAPTER IV PRIMARY TRADE UNION ORGANIZATIONS
第三十條 全民所有制企業(yè)職工代表大會(huì)是企業(yè)實(shí)行民主管理的基本形式,是職工行使民主管理權(quán)力的機(jī)構(gòu),依照《中華人民共和國全民所有制工業(yè)企業(yè)法》的規(guī)定行使職權(quán)。
Article 30 The representative assembly of the workers of an enterprise owned by
the whole people shall be the primary structure through which the enterprise
executes democratic management as it is the body through which the workers may
exercise their rights to democratic management in accordance with the provisions
of the Law of the People's Republic of China on Industrial Enterprises Owned by
the Whole People.
全民所有制企業(yè)的工會(huì)委員會(huì)是職工代表大會(huì)的工作機(jī)構(gòu),負(fù)責(zé)職工代表大會(huì)的日常工作,檢查、督促職工代表大會(huì)決議的執(zhí)行。
The trade union committee of an enterprise owned by the whole people shall be
the working body of the workers representative assembly and shall be responsible
for the daily affairs of the representative assembly and for inspecting and
supervising the implementation of resolutions of the representative assembly.
第三十一條 集體所有制企業(yè)的工會(huì)委員會(huì)應(yīng)當(dāng)支持和組織職工參加民主管理和民主監(jiān)督,維護(hù)職工選舉和罷免管理人員、決定經(jīng)營管理的重大問題的權(quán)力。
Article 31 The trade union committee of a collectively owned enterprise shall
support and organize workers' participation in democratic management and
democratic supervision and shall safeguard the rights of workers to elect and
dismiss administrative personnel and to determine important issues relating to
operational management.
第三十二條 全民所有制企業(yè)的管理委員會(huì)應(yīng)當(dāng)有工會(huì)代表參加。
Article 32 Trade union representatives shall participate in the management
committee of an enterprise owned by the whole people.
全民所有制企業(yè)召開討論有關(guān)工資、福利、安全生產(chǎn)以及勞動(dòng)保護(hù)、勞動(dòng)保險(xiǎn)等涉及職工切身利益的會(huì)議,應(yīng)當(dāng)有工會(huì)代表參加。
Trade union representatives shall participate in meetings convened by an
enterprise owned by the whole people to discuss matters, such as wages, welfare,
production safety, labour protection and labour insurance, which involve the
personal rights and interests of workers.
全民所有制企業(yè)廠長(經(jīng)理)應(yīng)當(dāng)支持工會(huì)依法開展工作,工會(huì)應(yīng)當(dāng)支持廠長(經(jīng)理)依法行使職權(quán)。
The factory head (manager) of an enterprise owned by the whole people shall
support the trade union in carrying out its work pursuant to the law and the
trade union shall support the factory head (manager) in performing his powers of
office pursuant to the law.
第三十三條 中外合資經(jīng)營企業(yè)、中外合作經(jīng)營企業(yè)研究決定有關(guān)工資、福利、安全生產(chǎn)以及勞動(dòng)保護(hù)、勞動(dòng)保險(xiǎn)等涉及職工切身利益的問題,應(yīng)當(dāng)聽取工會(huì)的意見。
Article 33 A Sino-foreign joint equity enterprise or Sino-foreign cooperative
enterprise researching and making decisions on matters, such as wages, welfare,
production safety, labour protection and labour insurance, which involve the
personal rights and interests of workers shall heed the views of its trade
union.
外資企業(yè)的工會(huì)可以對有關(guān)職工的工資、福利、安全生產(chǎn)以及勞動(dòng)保護(hù)、勞動(dòng)保險(xiǎn)等事項(xiàng)提出建議,同企業(yè)行政方面協(xié)商處理。
The trade union of a sole foreign investment enterprise may put forward
suggestions on matters, such as wages, welfare, production safety, labour
protection and labour insurance, which involve the personal rights and interests
of its workers and shall negotiate and resolve such matters in conjunction with
the enterprise's administrative authority.
第三十四條 基層工會(huì)委員會(huì)召開會(huì)議或者組織職工活動(dòng),應(yīng)當(dāng)在生產(chǎn)或者工作時(shí)間以外進(jìn)行,需要占用生產(chǎn)或者工作時(shí)間的,應(yīng)當(dāng)事先征得行政方面的同意。
Article 34 A primary trade union committee convening a meeting or organizing
activities for workers shall do so in time outside production or work hours. If
it is necessary to occupy production or work hours, prior approval from the
administrative authority shall be required.
全民所有制和集體所有制企業(yè)工會(huì)不脫產(chǎn)的委員因參加會(huì)議或者工會(huì)組織的活動(dòng),占用生產(chǎn)或者工作時(shí)間,其工資照發(fā),其他待遇不受影響。
If a trade union committee member of an enterprise owned by the whole people or
a collectively owned enterprise who has not been released from regular work
duties uses production or work hours to participate in a union meeting or other
activities organized by the trade union, the member's wages shall be issued as
usual and other benefits shall not be affected.
第三十五條
全民所有制和集體所有制企業(yè)事業(yè)單位以及機(jī)關(guān)工會(huì)委員會(huì)的脫產(chǎn)專職工作人員的工資、獎(jiǎng)勵(lì)、補(bǔ)貼,由所在單位行政支付。勞動(dòng)保險(xiǎn)和其他福利待遇等,享受本單位職工同等待遇。
Article 35 Trade union committee members of an enterprise or public institution
owned by the whole people, a collectively owned enterprise or public institution
or government organ who are released from regular work duties to act as
full-time union personnel shall have their wages, awards and bonuses paid by the
said unit's administrative authority. With regard to labour insurance and other
welfare benefits, the same treatment shall apply as received by the said unit's
workers.
第五章 工會(huì)的經(jīng)費(fèi)和財(cái)產(chǎn)CHAPTER V TRADE UNION FUNDS AND ASSETS
第三十六條 工會(huì)經(jīng)費(fèi)的來源:
Article 36 The sources of trade union funds shall be as follows:
(一)工會(huì)會(huì)員繳納的會(huì)費(fèi);
(1) membership dues paid by union members;
(二)建立工會(huì)組織的全民所有制和集體所有制企業(yè)事業(yè)單位、機(jī)關(guān)按每月全部職工工資總額的百分之二向工會(huì)撥交的經(jīng)費(fèi);
(2) monthly allocations of 2% of the total wages of all of its employees paid to
a trade union as funds by the enterprise or public institution owned by the
whole people, collectively owned enterprise or public institution or government
organ which established the said trade union organization;
(三)工會(huì)所屬的企業(yè)、事業(yè)單位上繳的收入;
(3) income handed over by enterprises and public institutions subordinate to the
trade union;
(四)人民政府的補(bǔ)助;
(4) people's government subsidies;
(五)其他收入。
(5) other income.
建立工會(huì)組織的中外合資經(jīng)營企業(yè)、中外合作經(jīng)營企業(yè)、外資企業(yè)依照國家有關(guān)規(guī)定向本企業(yè)工會(huì)撥交經(jīng)費(fèi)。
A Sino-foreign joint equity enterprise, Sino-foreign cooperative enterprise or
sole foreign investment enterprise establishing a trade union organization shall
allocate funds to the said trade union pursuant to relevant State regulations.
工會(huì)經(jīng)費(fèi)主要用于基層職工的教育和工會(huì)開展的其他活動(dòng)。經(jīng)費(fèi)使用的具體辦法由中華全國總工會(huì)制定。
Trade union funds shall be used primarily to educate workers at the grass-roots
level and for the union to arrange other activities. Detailed measures on the
use of such funds shall be formulated by the All-China Federation of Trade
Unions.
第三十七條 工會(huì)應(yīng)當(dāng)根據(jù)經(jīng)費(fèi)獨(dú)立原則,建立預(yù)算、決算和經(jīng)費(fèi)審查監(jiān)督制度。
Article 37 A trade union shall work out its own budget and final accounts, as
well as its own fund inspection and supervisory systems in accordance with the
principle of independent accounting.
各級工會(huì)建立經(jīng)費(fèi)審查委員會(huì)。
All of the various levels of trade unions shall establish fund inspection
committees.
各級工會(huì)經(jīng)費(fèi)收支情況應(yīng)當(dāng)由同級工會(huì)經(jīng)費(fèi)審查委員會(huì)審查,并且定期向會(huì)員大會(huì)或者會(huì)員代表大會(huì)報(bào)告,接受監(jiān)督。工會(huì)會(huì)員大會(huì)或者會(huì)員代表大會(huì)有權(quán)對經(jīng)費(fèi)使用情況提出意見。
The fund income and expenditure situation of trade unions at the various levels
shall be investigated by equivalent level fund inspection committees and
periodic reports shall be made to the members' general assemblies or
representative assemblies and be subject to supervision. A trade union general
assembly or representative assembly shall have the right to put forward
suggestions on the use of trade union funds.
第三十八條 各級人民政府和企業(yè)、事業(yè)單位、機(jī)關(guān)應(yīng)當(dāng)為工會(huì)辦公和開展活動(dòng),提供必要的設(shè)施和活動(dòng)場所等物質(zhì)條件。
Article 38 People's governments at the various levels and enterprises, public
institutions and government organs shall provide the necessary facilities,
venues and other material requirements of trade union organizations handling
office matters and arranging union activities.
第三十九條 工會(huì)的財(cái)產(chǎn)、經(jīng)費(fèi)和國家撥給工會(huì)使用的不動(dòng)產(chǎn),任何組織和個(gè)人不得侵占、挪用和任意調(diào)撥。
Article 39 No organization or individual may occupy, misappropriate or
arbitrarily allocate a trade union's assets, funds or immovable property
allocated by the State for use by the trade union.
第四十條 工會(huì)所屬的為職工服務(wù)的企業(yè)、事業(yè)單位,其隸屬關(guān)系不得隨意改變。
Article 40 The jurisdictional framework of those enterprises and public
institutions servicing workers which are subordinate to trade unions shall not
be altered arbitrarily.
第四十一條 縣級以上各級工會(huì)的離休、退休人員的待遇,與國家機(jī)關(guān)工作人員同等對待。
Article 41 Persons retiring from positions with trade unions at county level or
above shall receive the same benefits as persons working for State organs.
第六章 附 則CHAPTER VI SUPPLEMENTARY PRINCIPLES
第四十二條 本法自公布之日起施行。1950年6月29日中央人民政府頒布的《中華人民共和國工會(huì)法》同時(shí)廢止。
Article 42 This Law shall take effect from the date of promulgation. The Trade
Union Law of the People's Republic of China, issued 29 June 1950 by the People's
Central Government, shall be annulled simultaneously.
